By opting in to receive text messages from Outdoorsiness or its subsidiaries and affiliates (collectively referred to as “We,” “Us,” “Our”) (the “Service”), you agree to the following Text Messaging Terms and Conditions (the “Agreement”). Participation in the Service is also governed by our Privacy Policy and Terms and Conditions of Use, which are expressly incorporated herein. This Agreement does not modify any other Terms and Conditions or Privacy Policy that may govern your relationship with Us in other contexts.
IMPORTANT: OUR TERMS AND CONDITIONS OF USE REQUIRE YOU TO RESOLVE DISPUTES WITH US ON AN INDIVIDUAL BASIS, WAIVE YOUR RIGHT TO A JURY TRIAL, AND REQUIRE THAT CLAIMS BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION. IF YOU DO NOT AGREE TO THESE TERMS, YOU MAY NOT PARTICIPATE IN THE SERVICE.
Providing Telephone Numbers and Duty to Notify: You confirm that the mobile number you provide to Us is accurate and that you are the current subscriber or owner of that number. If your contact information changes, including your telephone number, you agree to notify Us immediately by emailing us at [email protected] before the change takes effect.
Consent to Receive Automated Calls/Texts: By voluntarily providing your telephone number(s), you expressly consent to receive recurring automated text messages (e.g., SMS, MMS, or other protocols) from Us about our products, services, offers, promotions, and your relationship with Us. Consent is not required to make any purchase. Standard message and data rates may apply.
Opt-Out Instructions: Your consent to receive automated texts is entirely voluntary. You may opt out at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any text from Us, or by emailing [email protected] with your request to opt out. For assistance, you may also text HELP or email [email protected]. You agree to receive a final confirmation text after opting out.
Indemnification: You agree to indemnify Us against any privacy, tort, or other claims, including claims under the Federal Telephone Consumer Protection Act or state law equivalents, arising from your voluntary provision of a telephone number that is not your own or your failure to notify Us of changes to your mobile number. You will indemnify, defend, and hold Us harmless from any such claims, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees).
Participation Requirements: By participating in the Service, you confirm that you are at least eighteen (18) years old. You must have a wireless device capable of two-way messaging, use a participating wireless carrier, and be a subscriber with text messaging service. Not all cellular providers offer the necessary service to participate. Check your phone’s capabilities for specific instructions.
Miscellaneous: You represent and warrant that you have all necessary rights, power, and authority to agree to these Terms and fulfill your obligations under this Agreement, without breaching any other contract or obligation. If any provision of this Agreement is deemed unenforceable or invalid, that provision will be limited or removed as necessary, and the remaining provisions will remain in full force and effect. We reserve the right to modify this Agreement at any time. Any updates will be communicated to you, and it is your responsibility to review the Agreement periodically. Continued participation in the Service after any changes signifies your acceptance of the modified Agreement.
